General terms of use for the usage of crossingways.com
Crossingways.com, below stated as licensee, is an interactive online offer that combines the functions of a tour portal and a social network. Users can place tours formatted with descriptions, pictures and othe multimedia based contents, watch tours of other users, contact those and thus build and cultivate friendships.
1.) Validity
The licensee enables the access an usage of the portal based on those terms of use. They control the relationship between licensee and the registering user, as well as the relationhip among users.
2.) Registration
Public functions as search for or watch tours, in case the creator of the tour has declared it as public, can be used without registration. To use futher function, such as the creation of tours or interaction with other users, requires a registration. This is free of cost.To register the user has to fill in the data of the registering form complete and correct.It is prohibited to create an account using different or further incorrect data. A registration has completed successfully if the user verifies the stated email address through a link, recieved in a confirmation email.
An identification of persons in the internet is only possible in a limited way. Thus it cannot be excluded by the licensees that incorrect contact data is used when register. The licensee does not guarantee for the actual identity of a user.Each user has to see for oneself about the identity of another user.
3.) Cancellation
A user can cancel the licence agreement at any time without indication of reasons.To do this, the user has to declare the cancellation by sending an email to support[at]crossingways.com and adding the user details and stated email address. Also, the licencee is allowed to cancel the licence agreement at any time – within a period of fourteen days at the end of the month.
With the cancellation, the account and all personal data is deleted permanently. Those contributions that have been made public by the user (e.g. posts in the forum), can be seen after the cancellation, but without stating the user, but stating this comment has been made by a deleted user.
4.) Violation of terms of use
If there are concrete evidence that a user violates the terms of use or violates legal regulations, rights of third parties or morality the licencee is allowed to block or immediately delete the account and all content created by the user.If a user had been blocked, all usage of the portal is prohibited. This includes a new registration.
5.) Upload of content
Each registered user has the possibility to upload tours online and add explanations and pictures. The licensee offers the technical basic conditons. The copyright of the tours (GPS-Track, descriptions, pictures, etc) lies within the user. Before uploading a tour and included pictures the user has to make sure that he / she has all rights of use for the data or the picture and the public access does not violate legal regulations, morality and rights of third parties. It is prohibited to upload pictures with gore, sexual, discriminating, insulting, racist, defamatory or further illegal content and/or make pubicly available. An upload that shows other persons can only be done with the approval of those persons.
6.) Liability
The usage of tours, that can be seen on the portal is at one's own risk. The licencee as well as the users among themselves exclude any liability for damages, resulted from the usage of our offer.
If rights of third parties are violated by the content of a user, he / she discharges the licencee of all claims. In this case, the user takes over all legal costs of the licencee.

8.) Miscellanous
If a clause of this terms of use becomes invalid, all the other clauses remain valid. The objected article has to be replaced by one that comes as close as possible to the economic intent.
Only Austrian right is applied to the mentioned terms of use and the contractual relationship between user and licencee. Jurisdiction for all disputes that can occur between user and licencee, is Graz, Austria
